INOMHUS BARTOSZ MALINOWSKI sells via the Internet via the website shop.theinomhus.com.
Information about currently available products is published on theinomhus.com/shop website. The product information on the website does not constitute an offer within the meaning of the Civil Code, but an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code. Sending an order by the Customer is tantamount to submitting an offer to conclude a sales contract for the products covered by the order on theinomhus.com/shop website.

Orders are accepted by INOMHUS BARTOSZ MALINOWSKI via theinomhus.com/shop website. INOMHUS BARTOSZ MALINOWSKI, via the website, collects and processes the following personal data of Users provided during the order fulfillment processes on the website:

– name and surname,
– address,
– e-mail address,
– phone number.

Processing your personal data allows us to provide services, like: fulfilling orders, contact related to the execution of the above-mentioned order, as well as sending marketing information (including the newsletter). The above-mentioned personal data may be transferred to the payment operator and courier companies for further processing of the order in the INOMHUS store.

Personal data will be stored for the duration of the contract and for a period in accordance with applicable regulations, taking into account the limitation period for claims and tax liabilities. Personal data for which you have consented will be stored until you withdraw your consent. The user has the right to view and change his/her personal data at any time, as well as to request INOMHUS BARTOSZ MALINOWSKI to immediately delete them. INOMHUS BARTOSZ MALINOWSKI undertakes to make every effort to properly secure the Customer’s personal data. You can submit requests regarding the processing of personal data by e-mail to the data administrator’s address: shop@theinomhus.com.

At the same time, you have the right to file a complaint with the supervisory authority responsible for the protection of personal data – the President of the Personal Data Protection Office.

The website theinomhus.com/shop, in order to facilitate ordering, provides a graphic interface of the online store, including a basket containing a list of products that have been selected by the Customer to place an order at a given moment. Before sending the order, you can check the contents of the basket at any time by clicking the “Checkout” button. The order summary will be visible in the “Summary” section.

To place an order, the Customer completes and sends the order form available at theinomhus.com/shop. By completing the form, the Customer selects the products ordered, their quantity, selects the payment method and indicates the shipping address and contact details.

Submitting the form means that you have read the Regulations and accept them.
The customer will receive confirmation of the order and payment acceptance automatically from theinomhus.com/shop website.

An e-mail confirming the order will be automatically generated and sent to the address provided in the order and constitutes INOMHUS BARTOSZ MALINOWSKI’s declaration of acceptance of the Customer’s offer. Upon submission of this declaration, a sales contract for the ordered products is concluded between INOMHUS BARTOSZ MALINOWSKI and the Customer.

PAYMENTS

Placing an order entails an obligation to pay. The customer can choose the following payment methods for the ordered goods: BLIK payments, credit card, electronic wire transfer via the external imoje payment system (operated by ING Bank Śląski S.A. with its registered office in Katowice) and payments via the PayPal platform.

Changing the order or canceling the order is possible until the products are shipped. To change the order or to cancel it, please contact INOMHUS at shop@theinomhus.com.

Product prices on the website are given in Polish zlotys (PLN). Shipping costs are quoted separately (“Shipping”). INOMHUS BARTOSZ MALINOWSKI charges a fee covering the cost of sending the shipment to the Customer in the amount depending on the selected shipping method. The shipping cost is added to the order amount.

ORDER FULFILLMENT

Orders are processed immediately, and the order processing begins no later than 2 business days after the payment is received. Working days should be understood as days from Monday to Friday, excluding public holidays. INOMHUS BARTOSZ MALINOWSKI is obliged to deliver the goods without defects. The goods are not covered by the manufacturer’s warranty.

INOMHUS BARTOSZ MALINOWSKI is not responsible for non-delivery of products or possible delay in delivery caused by an incorrect or inaccurate address provided by the Customer.

DELIVERY METHODS

Available delivery methods for products purchased in the theinomhus.com store are Paczkomaty InPost or Kurier InPost within Poland, and delivery using Global Expres in the case of an order shipped outside of Poland.

The cost of shipping to Paczkomat InPost is 18.99 PLN.
The cost of shipping by Kurier InPost is 20.99 PLN.
The cost of shipping abroad with Global Expres is 50 PLN.

COMPLAINTS

The buyer has the right to withdraw from the concluded contract in writing without giving a reason within fourteen days from the date of conclusion of the contract pursuant to the Act of May 30, 2014 (Journal of Laws of 2014, item 827, as amended). In the event of written withdrawal from the contract, the Customer is obliged to return the goods within fourteen days. The right referred to above also applies to a natural person concluding a contract directly related to his/her business activity, when the content of this contract shows that it does not have a professional character for this person, resulting in particular from the subject of his/her business activity, made available on the basis of provisions on the Central Registration and Information on Business.

The customer is obliged to return the delivered products to INOMHUS BARTOSZ MALINOWSKI (in a complete and unchanged condition) immediately, but no later than 14 days from the date on which he withdrew from the contract. The products should be sent back to INOMHUS BARTOSZ MALINOWSKI (“Complaint Address”).
In order to exercise the right of withdrawal, you must submit an appropriate declaration of withdrawal from the contract within the deadline indicated above and send it to the address INOMHUS BARTOSZ MALINOWSKI (“Complaint Address”) or deliver it by e-mail to shop@theinomhus.com. If the 14-day right of withdrawal is exercised, the cost of returning the goods is covered by the buyer. In the case of entrepreneurs purchasing for purposes unrelated to their business, the rights related to the warranty for defects in the products sold are excluded.

INOMHUS BARTOSZ MALINOWSKI shall immediately, no later than within 14 days from the date of receipt of the declaration of withdrawal from the contract, refund all payments made by the Customer using the same payment methods that were used in the transaction.
INOMHUS BARTOSZ MALINOWSKI is obliged to release products without defects. If a product defect is found, the Customer has the rights described in the Civil Code, in particular the right to submit a complaint. In accordance with the principles set out in the Civil Code, the Customer may request repair of the product, replacement of the product with a defect-free one, reduction of the product price, or withdrawal from the sales contract.

The product complained by the Customer (not in accordance with the contract), together with a description of the reason for the complaint, should be sent to the address INOMHUS BARTOSZ MALINOWSKI (“Complaint address”) with the note: “Complaint”. INOMHUS BARTOSZ MALINOWSKI considers complaints immediately, no later than within 14 days from the date of receipt of the complaint.

In matters not regulated by these regulations, the relevant provisions of law shall apply, in particular the Civil Code and the Act of May 30, 2014 on consumer rights.
